1.0 Introduction
Simuscape Terms of Use,
General Rules, Privacy Policy, and Copyright Notices are listed for clarification and will
be referred to as needed. Reviewing these rules, notices and/or conditions, while entirely
elective, is strongly recommended.
1.1 Terms of Use Acceptance and Amendments
You agree to bound by these
Terms of Use at any occasion you use or cause access to this site, as amended from time to
time with or without notice to you. In addition, usage of a particular service on this
site or accessed via this site, you'll be subject to any rules or guidelines applicable
to those services, and as such they will be incorporated by reference within these Terms of
Use.
1.2 Site Editor Service
This site and any of its
services provided either on or via this site are subject to an "as is" basis. You
agree that the site editor reserves the right to modify, discontinue provision of the site
and its services, and remove data provided by you, temporarily or permanently at any time,
without notice and without any liability towards you. The site editor will not be held
responsible or liable for timeliness, removal of information, failure to store information,
accuracy of information, or improper delivery of information.
1.3 Registration Obligations
Full usage of this site in
terms of enabling all features, removal of restrictions and gain additional access, requires
registration of a user account. When registering you agree to provide valid information when
requested, and you explicity agree to our Terms of Use, including any amendments made by the
site editor published herein.
1.4 Privacy Policy
Registration data and other
personally identifiable information collected is subject to the terms of our site
editor's Privacy Policy.
1.5 Registration, Username and Password
You agree to the
responsibility of maintaining the confidentiality of your password, and as such you'll
be held responsible for all usage of your user account and/or username, whether authorized
or not by you. You agree not to select a username which can either be identified as, or is
similar to a generated username normally recorded and used by spam bots. Similarly, you
agree not to choose a username that refers to this site or otherwise is similar to another
user's username. You agree to immediately notify the site editor of any unauthorized use
of your user account, username or password.
1.6 Your Conduct
You agree that all
information or data of any kind, whether text, graphics, software, code, music or sound,
photographs, video or other content, made available publicly or privately, will be under the
sole responsibility of the provider, or the providing user account. You agree that this site
may expose you to content that may be objectionable or offensive. The site editor will not
be responsible for any content displayed, nor for any error or omission.
Usage of this site or any of its provided services, means you explicity agree that;
- you will not provide any content or conduct yourself in any way that may be construed
as: unlawful; illegal; threatening; harmful; abusive; harassing; stalking; tortious;
defamatory; libelous; vulgar; obscene; offensive; objectionable; pornographic; designed to
interfere with or disrupt the operation of this site or any service provided; infected with
a virus or other destructive or deleterious programming routine; giving rise to civil or
criminal liability; or in violation of an applicable local, national or international law.
- you will not impersonate or misrepresent your association with any person or entity.
- you will not forge or otherwise seek to conceal or misrepresent the origin of any
content provided by you.
- you will not collect or harvest any information about other users.
- you will not provide, and you will not use this site to provide any content or service
in any commercial manner, or in any manner that would involve junk mail, spam, chain
letters, pyramid schemes, or any other form of unauthorized advertising or commerce.
- you will not use this site to promote or operate any service or content without the site
editor's prior written consent.
- you will not provide any content that may give rise to the site editor being held
civilly or criminally liable, or that may be considered a violation of any local, national
or international law, including -- but not limited to -- laws relating to copyrights,
trademarks, patents, or trade secrets.
1.7 Content Submission
By providing any content to
this site, you agree to grant the site editor a worldwide, royalty-free, perpetual,
non-exclusive right and license, (including any moral rights or other necessary rights), to
use, display, reproduce, modify, adapt, publish, distribute, perform, promote, archive,
translate, and to create derivative works and compilations, in whole or in part. Such
license will apply with respect to any form, media, technology already known at the time of
provision or developed subsequently, (e.g. we are allowed to publish your submissions live
to our site worldwide for anyone to access). User accounts upgraded to the Artists Guild
earn specific privileges, obtained and validated at the time of the upgrade. Such specific
circumstances may also apply to whole or parts of permissions for user admittance of the
Simuniquem area.
Content provided through the Wikiscape Catalogues, submitted by the site editor, is subject
to individual licenses supplied by the copyright holding author at the time of submission,
and as such displayed with each item listed.
Further you warrant and represent that you have all legal, moral, and other rights that may
be necessary to grant the site editor the license specified in section 1.7 of our Terms of
Use. You also acknowledge and agree that the site editor will have the right, (but not the
obligation), at the site editor's entire discretion, to refuse to publish, to remove, or
to block access to any content you provide, at any time and for any reason, with or without
notice.
1.8 Third-party Services
Goods and services of third
parties may be advertised and/or be made available on or through this site. Representations
made regarding products and services provided by third parties will be governed by the
policies and representations made by these third parties. The site editor will not in any
manner be liable for or responsible for any of your dealings or interaction with third
parties.
1.9 Indemnification
You agree to indemnify and
hold harmless the site editor and the site editor's representatives, subsidiaries,
affiliates, related parties, officers, directors, employees, agents, independent
contractors, advertisers, partners, and co-branders, from any claim or demand, including
reasonable legal fees, that may be filed by any third party, arising out of your conduct or
connection with this web site or service, your provision of content, your violation of these
Terms of use, or any other violation by you of the rights of another person or party.
General Terms
2.1 Member Responsibilities
As a registered member of
Simuscape you are responsible to read and comply with these rules, and preferably on a
regular basis as they may be updated at anytime. The Administrative Team, Team Simuscape,
including, but not limited to, the Artists Guild and other staff members will endeavor to
give members reasonable notice of such changes. These rules apply to all forums on Simuscape
unless otherwise stated.
2.2 Specific Forums and Sub-Forums
Some forums and/or sub-forums
have their own specific set of rules to be followed. In such case, these set of rules are
clearly marked by the forum/sub-forum master, (e.g. Artist Guild member, Simuniquem member).
A member, by invitation or by own request, granted permission to be upgraded to an Artist
Guild member is obliged to accept and sign the Simuscape Non Disclosure Agreement, NDA;
It is the sole responsibility of an Artist Guild member to request for an invited member to
join the Artist Guild Team to accept and sign the Simuscape Non Disclosure Agreement, NDA.
2.3 Communication
Private Messages, (pm's),
sent by the Administrative Team, Team Simuscape, will be considered read once the member has
subsequently logged on to the site. It is the responsibility of each member to ensure that
the registration e-mail address supplied is valid and regularly checked. Failing to provide
a valid e-mail address may lead to an account deactivation.
2.4 Simuscape Administrative Team, Team Simuscape
Administrators, assisting
administrators, moderators and other staff members are responsible for the smooth and
efficient running of the site. The Administrative Team, Team Simuscape, reserves the right
to take whatever action is deemed appropriate in any given situation, regardless of whether
there is a specific rule covering that situation or not. If there is a misunderstanding or
dispute, bring the issue up politely with that staff member in private. In all matters, the
decision of the Administrative Team, Team Simuscape is final.
When appointing new staff members, the Administrative Team, Team Simuscape, only pick
trusted, active, and helpful members to fill vacant positions. Staff positions are never
obtained by asking or campaigning for them.
2.5 Prohibited Actions
It is strictly and expressly
prohibited to post or upload;
-
Anything relating to the pirating, or copying, of any software game title.
-
Anything referring to CD keys or no CD cracks.
-
Any content malicious to computer hardware or software, such as viruses
-
Any content that violates another members privacy.
-
Any material that is the work of another individual but is being represented as original.
Permission must be obtained from the original creator, and due credit must be given, before
including any element of that creator's work in custom content upload.
2.6 General Site Conduct
It's recommended that
members do not give out personally identifiable information to anyone else on the site or
the internet. There is a zero tolerance for the following behavior;

Swearing, (masked or otherwise), offensive, or profane language.

Any offensive, pornographic, or obscene material.
-
Overt sexually loaded comments or content.
-
Discrimination against the age, race, gender, religion, ethnicity, nationality, or sexual
orientation of another member

The personal safety of our members is a primary concern. Any inappropriate or unwelcome
attention, harassment, solicitation, or sexually orientated comments or behavior directed
towards another member, either publicly or privately, should be immediately reported to the
Administrative Team, Team Simuscape.

Inappropriate use of Simuscape User Accounts. The following is not permitted;

Creating or using a clone account while banned.
-
Using clone accounts to bump the original users threads, double post, or to otherwise
disrupt the forums.
-
Creating spam-bot accounts solely for advertising purposes.
The Administrative Team use a range of options to deal with breaches of the site rules. The
staff will always endeavor to use the fairest and lightest method available. Common sense
rules, like politeness, are not explicitly stated but are still enforced.
2.7 Forum Activities
Regular forum posts should
normally be posted in the default text size, color and font. Exceptions include the use of
text formatting tools and color of more creative posts.
What happens at a different site stays at that site, (e.g. if a member has a dispute or
grievance with another member, moderator, administrator, or webmaster of a site other than
Simuscape, it may not be brought here for discussions).
Users may not post within their own thread simply for the sake of making that thread appear
at the top of the forum. This is commonly referred to as "bumping". The edit
function should be used to add to a previous post.
Do not revive or bump old threads after they have dropped to the later pages, unless there
is significant new topical information to add. Please make an effort to find the right
forum to ask questions or post a new topic. Many common questions have already been
answered, and a simple search may locate most of them. Please attempt to find the answer
through our search machine first, before posting a new thread.
All threads are advised to use an informative title describing the topic or question
accurately. “Help!!!" or "Hallo!!!” is unlikely to
get many useful responses, and is generally considered misleading. Such titles may be
alterred by the staff.
2.8 Site Language
Simuscape, although located
in Sweden, is an English speaking forum with an international audience. Proper spelling and
grammar is generally expected. Overuse of net-speak or txt abbreviations should be avoided.
Please be patient and courteous with non-native English speakers trying to write in English.
Privacy Policy
3.0 Introduction
The Simuscape administration
considers your right to privacy most seriously, in that you should feel comfortable using
this site. Our Privacy Policy deals with personally-identifiable information, below referred
to as "data", that may be collected. Our Privacy Policy doesn't apply to other
entities not owned or controlled by the site editor, nor does it apply to users not
employees of the site editor, or that are not under the site editor's control.
3.1 Data Collection
To take advantage of the full
content of Simuscape a membership registration is required. Registration of such an account
requires a valid e-mail address and a username that has not been chosen by another member.
You are not required to provide any other information should you not want to. Be aware that
the username of your choice, your e-mail address provided, and any other entered information
may render you personally identifiable. This may possibly be displayed on this site
intentionally depending on your choices during the registration process, or unintentionally
subsequent to a successful act of intrusion by a third party. Similar to many other sites,
the site editor may also automatically obtain general information contained in server log
files, such as your IP address and cookie information. Information about advertising and how
it may be served on this site, in such case it's indeed the site editor's policy to
display advertising, is set forth below.
3.2 Data Usage
Data obtained may be used to
further customize and improve your user experience on Simuscape. Undoubtedly efforts will be
made to prevent your data from being available to third parties unless,

provided for otherwise stated in this Privacy Policy,

your consent is obtained, (e.g. when you choose to opt-in or opt-out for the sharing of
data,

site service is provided which requires interaction with a third party, or provided by a
third party, (e.g. application service provider),

your usage of this site violates the site editor's policy, terms of service, or other
usage guidelines, or if it's deemed reasonably necessary by the site editor to protect

this site is purchased by a third party, in which case that third party will be able to use
the data in the same manner as set forth in this policy. It's adviced in such event you
use links displayed on this site to visit other sites, you should get familiar with privacy

3.3 Cookies
Similar to many other sites,
this site sets and uses cookies to enhance your user experience, and further to acknowledge
for instance personal settings. In the event commercial advertisments may be displayed on
this site, cookies may be set and accessed on your computer, although being subject to
privacy policies provided by parties providing the advertisment. It should be noted that
parties providing advertisments do not have access to this site's cookies.
3.4 Minors
The site editor does not, at
this point, disallow underaged users as a result of the current site content. For more

3.5 Account Editing
You are provided with the
ability to edit the information stored for your user account during registration. For
editing purposes, visit your User Control Panel. You are also provided with the ability to
delete your user account, and content or other data provided, not stored within your user
account, may continue to remain on this site at the site editor's discretion. User
accounts upgraded to the Artists Guild earn specific privileges, obtained and validated at
the time of the upgrade. Such specific circumstances may also apply to whole or parts of
permissions for user admittance of the Simuniquem area.
3.6 Privacy Policy Changes
When necessary or prompted for,
changes may be made to this policy. Substantial changes will be announced on the site, or in
particular cases, by e-mail messages sent to your initially provided, (i.e. account registering),
e-mail address, stored within your user settings.
3.7 No Guarantees
While this privacy policy states
standards for maintenance of data, and while efforts will be made to meet said standards, the site
editor is not in a position to guarantee compliance with these standards. There may be factors
beyond the site editor's control resulting in disclosure of data. Consequently, the site
editor offers no warranties or representations regarding maintenance or non-disclosure of data.

this site, or by using this site and the services it provides, you accept that jurisdiction
is granted to the courts having jurisdiction over the site editor's domicile, and that
any disputes will be heard by the said courts.

6.1 Miscellaneous Information
In the event that any
provision of these Terms of Use, (including General Terms, Privacy Policy, Legalities, and
Copyright Notices), is deemed to conflict with legislation by a court with jurisdiction over
the parties, the said provision will be interpreted to reflect the original intentions of
the parties in accordance with applicable law, and the remainder of these Terms of Use will
remain valid and applicable. The failure of either party to assert any right under these
Terms of Use will not be considered to be a waiver of that party's right, and the said
right will remain in full force and effect. You agree that any claim or cause in respect of
this site or its services must be filed within one, (1), year after such claim or cause
arose, or the said claim or cause will be forever barred, without regard to any contrary
legislation. The site editor may assign the site editor's rights and obligations under
these Terms of Use; in this event, the site editor will be relieved of any further
obligation.
6.2 Miscellaneous Statement
Simuscape is not a democracy, and
while we try to accomodate everyone, rather think of Simuscape as a benevolent dictatorship ruled
by "SAC the Dragon"...
